Sukuk is no different from any other financing and investment product, be it Islamic or conventional, in terms of its exposure to default scenario. Whilst the business causes leading to Sukuk default are manifold, the ultimate reason for the default is the Issuer’s failure to pay the Sukuk investors their dues in accordance with the terms governing the Sukuk issuance.This leads to the triggering of an event of default or dissolution event, as the case may be. Recent Sukuk default cases for example the East Cameron Gas Sukuk and Dar Investment Sukuk are worthy of discussion. Sukuk, like many other Islamic financial products may be restructured either prior to or after the event of default or dissolution of the Sukuk. Nevertheless, the Sukuk restructuring shall be equally Shariah compliant as the existing Sukuk investors who are Islamic-based investors may continue holding their interest in the restructured Sukuk. Obviously, Sukuk restructuring poses many issues and challenges from legal, practice and Shariah perspectives which this session will attempt to address.
